SAM 23 Campaign Team Determines for 2023 Elections
The attention of the SAM 23 Campaign Secretariat has been drawn to a Press Statement issued by Hon. Abdul Kargbo and others in the name of the APC ITGC 21 Man Committee particularly paragraph 3 to wit “In tandem with Paragraph 90(10)4) of the Judgment and Art. 13 (f &g) of the Party’s 2022 Constitution, members that RESIGNED , EXPELLED OR OTHERWISE FORFEITED their membership of the party CAN ONLY BE REINSTATED OR READMITTED BY THE NATIONAL DELEGATES CONFERENCE ORGAN OF THE PARTY
Hon. Abdul Kargbo in paragraph 2 (3) further accused Chairman Alfred Peter Conteh of unilaterally; Reinstating Chief Alhali Sam Sumana who according to Hon. Abdul Kargbo can ONLY be reinstated or readmitted by the National Delegates Conference
The SAM 23 Campaign wishes to draw the attention of Hon. Abdul Kargbo and the entire membership of the APC ITGC 21 Man Committee to Paragraph 60 of the same ruling by Hon. Justice Fisher which states that, “In the light of the coming into force of the 2022 constitution and my judgment that the current executive is now defunct , by reason of their illegal assumption of office , the decision by the defunct executive to resolve all outstanding membership issues at the National Delegates Conference is NULL AND VOID by reason of their ILLEGALITY and would be contrary to the 2022 constitution now in force’’.
Meaning that all outstanding membership issues including that of Chief Sam Sumana MUST be resolved by the ITGC 21 Man Committee.
Consequently, the legal team of the SAM Campaign is referring Hon. Abdul Kargbo and the ITGC 21 Man Committee to the above ruling and unequivocally affirm that the reinstatement of Chief Alhaji Sam Sumana by Chairman Alfred Peter Conteh was done in conformity with paragraph 60 of the Hon. Justice Fisher’s ruling of 28th April 2022 quoted above.
The ruling in paragraph 60 clearly states that an illegal NAC executive by reason of their illegal assumption of office did not have the mandate in 2015 to expel Chief Sam Sumana in the first place, neither did they have the mandate to constitute an illegal NDC at Bintumani Conference Centre to endorse their illegality a second illegality cannot be borne out of a first illegality.
Consequently, the SAM 23 legal team wishes to state that Chief Sam Sumana was not properly and legally expelled from the APC in 2015 and that any such purported suspension was put to rest and declared null and void by Justice Fisher in his ruling.
In view of the above, the SAM 23 Campaign welcomes the reinstatement of Chief Sam Sumana back to the APC party in his original membership role for which all his back dues have been paid and a valid receipt issued by the APC party secretariat for same.
